LODI’S MAGICAL CHRISTMAS
ASSUMPTION OF RISK, RELEASE OF LIABILITY & WAIVER
PLEASE READ CAREFULLY. BY ENTERING OR PARTICIPATING IN LODI’S MAGICAL CHRISTMAS, YOU ACKNOWLEDGE AND AGREE TO THE FOLLOWING TERMS.
1. Event Participation and Assumption of Risk
I understand that attendance at and participation in Lodi’s Magical Christmas (the “Event”) involves certain inherent and other risks, whether known or unknown, including but not limited to: slips, trips and falls; uneven or wet surfaces; crowds; weather conditions; lighting and electrical displays; temporary structures and decorations; interactions with other attendees; parking and pedestrian traffic; food or beverage consumption; activities, attractions, entertainment, equipment, and other conditions associated with attending a public holiday event.
I voluntarily choose to attend and/or participate in the Event and knowingly assume the risks associated with my attendance and participation.
2. Release and Waiver of Liability
To the fullest extent permitted by California law, I, on behalf of myself and my heirs, family members, representatives, estate, successors, and assigns, hereby release, waive, and discharge Magical Light Shows, Lodi’s Magical Christmas, the Event organizers, property owners, sponsors, vendors, contractors, volunteers, employees, officers, directors, agents, affiliates, and representatives (collectively, the “Released Parties”) from claims, demands, actions, damages, losses, liabilities, costs, or expenses arising out of or relating to my attendance at or participation in the Event, including claims resulting from the ordinary negligence of a Released Party, to the extent such claims may lawfully be waived.
This release is intended to apply to personal injury, illness, death, property damage, theft, loss, or other harm arising from or related to attendance at or participation in the Event.
Nothing in this waiver is intended to release any claim that cannot legally be released under applicable law.
3. Personal Property
I understand and agree that the Released Parties are not responsible for lost, stolen, misplaced, or damaged personal property, including property located in vehicles or brought onto Event premises.
4. Responsibility for Children and Guests
I understand that parents, legal guardians, and responsible adults are responsible for supervising children and other persons in their care while attending the Event.
If I am signing or accepting this agreement on behalf of a minor child, I represent that I am the child’s parent or legal guardian or otherwise have legal authority to provide the acknowledgments and permissions contained in this agreement to the extent permitted by law.
5. Medical Treatment
In the event of an emergency, I authorize Event personnel to contact emergency medical services as reasonably necessary. I understand that the Released Parties do not guarantee the availability of medical personnel or treatment and are not responsible for the cost of emergency transportation, treatment, or other medical services provided to me or persons in my care.
6. Compliance with Event Rules
I agree to follow posted rules, safety instructions, and reasonable directions provided by Event personnel. I understand that the Event organizers reserve the right to refuse admission or remove any person whose conduct is unsafe, disruptive, unlawful, or otherwise inconsistent with Event rules, subject to applicable law.
7. Indemnification
To the fullest extent permitted by law, I agree to indemnify and hold harmless the Released Parties from claims, damages, losses, or expenses arising from my own negligent, reckless, unlawful, or intentional conduct while attending or participating in the Event.
8. Photography and Recording
I understand and acknowledge that photography, video recording, audio recording, and other forms of media may occur throughout Lodi’s Magical Christmas.
By entering, attending, or participating in the Event, I consent to being photographed, filmed, recorded, or otherwise captured in connection with the Event. I grant Magical Light Shows, Lodi’s Magical Christmas, and their respective affiliates, contractors, representatives, successors, and assigns the right to use, reproduce, publish, display, edit, distribute, and otherwise use my name, image, likeness, voice, and appearance in photographs, videos, recordings, social media content, advertisements, promotional materials, websites, and other Event-related marketing or publicity materials, in any media now known or later developed.
I understand and agree that such materials may be used for promotional, advertising, marketing, publicity, informational, or archival purposes without compensation, payment, royalties, or other consideration to me.
To the extent permitted by law, I waive any right to inspect or approve the finished photographs, videos, recordings, advertising materials, promotional materials, or other content in which my name, image, likeness, voice, or appearance may be used.
9. Governing Law and Severability
This agreement shall be governed by the laws of the State of California.
If any provision of this agreement is found to be invalid or unenforceable, that provision shall be limited or removed only to the extent necessary, and the remaining provisions shall remain in full force and effect.
10. Acknowledgment
I acknowledge that I have read and understand this Assumption of Risk, Release of Liability & Waiver. I understand that by accepting this agreement, purchasing or using a ticket subject to these terms, signing below, or otherwise agreeing to these terms as part of Event registration or admission, I may be giving up certain legal rights.
I voluntarily agree to these terms.
